Da Bomb Bath Fizzers Review Sweepstakes Terms & Conditions

The promoter of Da Bomb Bath Fizzers’ “Review Sweepstakes” is [Da Bomb LLC] ("Promoter" or “We”). The submission of an Entry (as defined in Section 3) in this Sweepstakes is deemed acceptance of these Terms and Conditions. This Sweepstakes is based on chance.

1. Date of Sweepstakes. You can enter the Sweepstakes during each calendar month, starting June 2024, on the 1st day of the month to 11:59 PM on the last day of the month. The Sweepstakes will automatically renew each month unless the promoter specifies otherwise.

2. Eligibility. This Sweepstakes is open to legal residents of the United States & Canada who are 18 or older as of the date of entry (“Entrant” or “You”) and who possess a web-enabled device. Employees of the Promoter and their immediate family members (spouse, parents, siblings, and children), respective subsidiaries, agencies, and affiliates are not eligible to enter or win this Sweepstakes. Any attempt by any Entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations, or logins, or any other methods will void that Entrant’s Entries and that Entrant may be disqualified from the Sweepstake.

3. How to Enter. There are 3 ways to enter the Sweepstakes:
   a. Email. An email will be sent to Entrants inviting them to review a product they previously purchased from dabombfizzers.com. Within the email, the Entrant will be prompted to click a ‘Share your thoughts’ hyperlink.
   b. Online. Entrants with an account may navigate to their ‘Order History & Reorder’ page and click a ‘Write a review’ hyperlink.
   c. Product Page. Entrants may navigate to a product page on dabombfizzers.com and click on the ‘Write a Review’ button. 

Entrants must write the Review during the Sweepstakes Period, provide all requisite information, and complete all necessary submission steps. For each eligible Review submitted, the Entrant will receive one (1) entry into the Sweepstakes. There is no limit to the number of entries an Entrant can submit.

4. Drawing/Odds. The winner will be determined by a random drawing, conducted by the 10th of the following month. The odds of winning will be determined by the total number of eligible entries received.

5. Prize. There will be one (1) winner who will be awarded a $100 Da Bomb Bath Fizzers gift card (“Prize”). The Prize is non-transferable, non-refundable, and cannot be exchanged for cash.

6. Notifications. The Winner will be notified by the Promoter by email within 10 days following the end of the Sweepstakes Period. The Winner must claim their Prize within 72 hours or a new winner will be selected.

7. Publicity. The Winner’s name may be announced and published on our websites or social media profiles. The Winner agrees that the Promoter may use their name, image, and/or the Prize for future promotional, marketing, and publicity purposes without notice and without a fee.

8. Use of Data. By participating, all participants consent to the use of their personal data for the purposes of this Sweepstakes in accordance with our Privacy Policy.

9. Release. By entering this Sweepstakes, each Entrant agrees to release the Promoter and its affiliates from any claim or cause of action arising out of participation or use of any Prize.

10. General Rules. In the event the Sweepstakes is compromised or impaired in any way for any reason, including but not limited to, fraud, virus, bug, unauthorized human intervention, outbreak of widespread illness, pandemic, or other similar occurrence, civil unrest or any other problem or other causes beyond the control of Promoter that corrupts or impairs the administration, security, fairness, or proper play of the Sweepstakes, Promoter reserves the right in its sole discretion to suspend or terminate the Sweepstakes and select the Prize winners from among all eligible Entries received during each Entry Period prior to cancellation. Promoter is not responsible for lost, late, misdirected, corrupted, or incomplete Entries. Proof of submission is not proof of receipt by Promoter. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the Entry process or the operation of the Sweepstakes or Website; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Promoter reserves the right to seek damages from any such person to the fullest extent permitted by law. Promoter’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

11. Disputes. Entrant agrees that: (a) he/she releases and will defend, indemnify and hold harmless the Released Sweepstakes Parties from and all any and all Claims (“Claims”); (b) Claims arising out of or connected with this Sweepstakes, or any prize awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or state court located in Minneapolis, MN; (c) Entrant submits to sole and exclusive personal jurisdiction to said courts in the State of Minnesota for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (d) any and all Claims, judgments, and awards shall be limited to actual damages of no more than $100, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (e) under no circumstances will Entrant be permitted to obtain awards for and Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrants or the Released Sweepstakes Parties in connection with this Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules of provisions (whether of the State of Minnesota, the United States, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Minnesota.
