Welcome to the Da Bomb Subscription Box operated by Da Bomb LLC. By accessing this website or purchasing products from us, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before using our services

1. Subscription Box Overview

1.1 The Da Bomb Subscription Box includes a monthly delivery of handmade bath bombs.
1.2 Each subscription box contains a predetermined quantity of bath bombs as specified in the product listing.
1.3 The actual bath bomb designs and fragrances will vary each month and may differ from the ones displayed in the listing images.

2. Eligibility:

2.1 To subscribe to the Da Bomb Subscription Box, you must be at least 18 years old or have the consent of a parent or legal guardian.

2.2 By subscribing, you warrant that all information provided is accurate, current, and complete.

3. Subscription:

3.1 By subscribing to the Da Bomb Subscription Box, you agree to be billed via credit or debit card automatically on a recurring basis according to the selected payment option.

3.2
Month-to-Month: You agree to pay for monthly delivery until you cancel your plan.
3-Month: You agree to pre-pay for 3 months delivery, after which your subscription will cancel.
6-Month:  You agree to pre-pay for 6 months delivery, after which your subscription will cancel 
In addition, an initial payment for the first month or period of the initial subscription will be charged immediately upon signing up and will cover the payment for the first month or duration of the first subscription term.

3.3 The available payment options are as follows:  

4. Payment and Billing:

4.1 You will be billed on the 10th / 15th of each month
4.2 Prices for the Tub Club Subscription Box are specified on our website and are subject to change without notice.
4.3 By subscribing, you authorize Da Bomb LLC to charge your provided payment method for the subscription fee according to the selected payment option.
4.4 You are responsible for maintaining up-to-date and accurate billing information.
4.5 Da Bomb LLC reserves the right to refuse any order and limit or cancel quantities purchased per person, household, or order.

5. Shipping and Delivery:

5.1 Subscription boxes are typically shipped between the 15th and 22nd of each month.

5.2 Delivery times may vary depending on your location.

5.3 Da Bomb LLC is not responsible for delays or failures in delivery caused by events beyond our control.

5.4 Any changes to your shipping address must be made at least 24 hours prior to the next billing cycle.

6. Cancellation and Refunds:

6.1 You may cancel your subscription after the initial pay period and request cancellation 5 days before the new billing cycle

1. a) Month to Month: Cancellation available after initial pay, 1 month of current subscription cycle
2. b) 3-Month: Automatic cancelation after 3 months
3. c) 6-Month:  Automatic cancelation after 6 months

6.2 Cancellation requests received after the billing date will apply to the following billing cycle.

6.3 Subscription fees are non-refundable, and cancellations will take effect from the next billing cycle.

6.4 Da Bomb LLC reserves the right to issue refunds or credits at our discretion in exceptional circumstances. 

7. Product Returns and Exchanges:

7.1 Due to the nature of the bath bomb products, we do not accept returns or exchanges.

7.2 If you receive a damaged or defective product, please contact our customer at support@dabombfizzers.com support within 7 days of delivery for assistance.

8. Intellectual Property:

8.1 All intellectual property rights related to the Bath Bomb Subscription Box, including designs, logos, and content, are owned by Da Bomb LLC.

8.2 You may not reproduce, distribute, modify, or use any intellectual property without prior written permission from Da Bomb LLC.

9. Third-Party Plugin:

9.1 Our Subscription box service is facilitated through a third-party Shopify plugin (Seal Subsciptions).

9.2 By subscribing to our service, you acknowledge and agree that certain aspects of the subscription management and payment processing are handled by our trusted third-party partner. We work closely with the third-party plugin to ensure a seamless and secure subscription experience for our customers. However, please note that any issues or disputes related to the functionality, performance, or data handling of the third-party plugin are subject to their respective terms and conditions and privacy policies.

10. Limitation of Liability:

10.1 Da Bomb LLC (referred to as "the Company")  shall not be held liable for any direct or consequential damages arising out of or in connection with the bath bomb subscription box, including but not limited to:

10.2 Product Usage: The Company assumes no responsibility for any injuries, allergies, or adverse reactions that may occur due to the use of the bath bombs provided in the subscription box. It is the subscriber's responsibility to read the product labels, follow the instructions, and perform a patch test if necessary before using the products.

10.3 Delivery: The Company will make reasonable efforts to ensure timely delivery of the subscription box; however, it shall not be responsible for any delays, shipping errors, or lost packages caused by third-party shipping providers or any unforeseen circumstances.

10.4 Product Variations: The Company reserves the right to modify the contents of the subscription box, including the selection of bath bomb scents, colors, or designs, based on product availability and seasonal changes. The images or descriptions of the products provided on the website or promotional materials may not always reflect the exact items received in the subscription box.

10.5 Subscription Modifications or Cancellations: The Company reserves the right to modify or cancel the subscription box service at any time, without prior notice. In the event of a cancellation, the Company will provide appropriate refunds or alternative options, as determined at its sole discretion.

10.6 Force Majeure: The Company shall not be liable for any failure or delay in performing its obligations under these terms and conditions if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to acts of nature, government restrictions, labor disputes, or equipment malfunctions.

The subscriber acknowledges and agrees that the limitations of liability stated above are fundamental elements of the agreement between the subscriber and the Company. By subscribing to the bath bomb subscription box, the subscriber agrees to waive any claims against the Company, its employees, officers, agents, and affiliates, to the fullest extent permitted by law.
